Please read carefully the following terms and conditions (the “Terms” or “Terms of Use“), as they constitute a binding agreement between you and Petits Fours Patisserie Limited. By accessing the Website or by using any of its services, you indicate your acceptance to these Terms. If you do not agree with any or all the Terms of Use, you may not access the website or use any of its services. The Service
When using the Website, you may review food and place an order for food and merchandise. Upon completing your order online, Petits Fours Patisserie Limited will review your order and acknowledge receipt with an e-mail message that will be sent to your e-mail address. Please note that Petits Fours Patisserie Limited’s e-mail notification does not constitute an acceptance of your order. The execution of your order and the charge of your credit card will be deemed as an acceptance of your order.

Petits Fours Patisserie reserve the right at any time and in their sole discretion, change the rates and availability of any item in their menu. All fees are quoted in Pound Sterling unless expressly stated otherwise. Any changes in fee rates will take effect immediately after being posted on the Website.

You represent and warrant that you will pay all fees and taxes in a timely manner and in compliance with each food fee schedule. Failing to settle your payments may prevent you from further using the Website, notwithstanding any other remedies available to Petits Fours Patisserie Limited under the applicable law.

Price Quotations

All price quotations, written or verbal, are valid for 30 days from the date of the quotations.

Decoration

Petits Fours Patisserie Ltd will endeavour to create your chosen style of cake. Decorative none-edible items and decorative chocolate finishing items are subject to availability and may vary. Seasonal fruit decorations are subject to availability on the day and may be substituted.

 

 

Cancellation and Alterations
If you have any queries or need to make any changes to an order please contact us immediately. We will assess your request for an alteration and let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of Petits Fours Patisserie Ltd. Alterations requested less than 2 weeks before completion may be subject to a surcharge. We cannot refund any of the cost of any cake orders (excluding fresh cream cakes) cancelled with less than 5 days notice. Orders paid in full and cancelled with more than 5 days notice (excluding wedding cakes) will receive a partial refund of 50% of the total amount paid. In the unlikely event that we have to cancel your order for any reason, we will give you as much notice as possible and we will refund the price in full.

 

Fresh Cream Cake – 24 hours notice for alterations. No cancellation charge for cakes up to 10”. Any personalised Fresh cream cake over 10” will be subject to cancellation charges of 50% if cancelled with less than 2 days notice prior to collection/delivery.

Iced Celebration Cakes – 5 Days notice for alterations.

A charge of 50% will be incurred for cancellations within 5 days of the order date.

Wedding Cakes 1 month notice for alterations.

 A charge of 50% will be incurred for cancellations within 5 days of the order date.

 

Consultations For Wedding Cakes

Consultations are by appointment only and usually take place on a Wednesdays or Sunday mornings. Appointments for a consultation and tasting must be agreed with Petits Fours Patisserie Ltd. You can book by filling in our Wedding Cake Consultation Form. The consultation fee must be paid prior to the consultation date before it can be confirmed. If you proceed to place a wedding cake order with us, the consultation fee will be deducted from the final price of your chosen cake. All appointments for consultations will be confirmed in writing (email) by Petits Fours Patisserie Ltd. Consultations are strictly limited to 2 persons. Cake tasting is included in the consultation fee.

Wedding Cake Deposits/Booking Fee & Final Payments

We require a 50% deposit on placement of wedding cake orders, which is then deducted from the final balance payable. Cancellations within 1 month of the agreed delivery date are non-refundable. This fee secures your date. All final balances need to be paid by the date shown on the proposal form. Please note when paying your deposit for your cake it is believed that you have read, understood and accepted our terms and conditions. As we only take a couple of wedding cakes per date the booking fee is non-refundable as we will have turned away business to accommodate your order.

Hire equipment & returning

Stands and other equipment are available for you to hire and must be returned to Petits Fours Patisserie within 2 days of the wedding date (unless alternative arrangements have been made prior to the wedding). A refundable deposit is required to guarantee the safe return of items. Failure to return items within the specified time, or at all may incur extra charges. The refundable deposit will be returned once the hired equipment is returned in satisfactory condition.

In Store Order-Collection

Collections must take place within specified business hours. Cakes collected from Petits Fours Patisserie Ltd (766 Stratford Road, Birmingham B11 4BP) require a proof of purchase/receipt by the person collecting, who will be required to check and sign to say that the cake was collected in perfect condition. Damages after this point are not Petits Fours Patisserie Ltd’s responsibility. All Petits Fours Patisserie Ltd’s cakes are fragile and require care and attention when handling, transporting, storing, and displaying. Petits Fours Patisserie Ltd will not be held responsible for damage caused due to mishandling by customers, on-site or in transit once it has left our premises.

 

 

Delivery

Our Free cake delivery service is available for customers within a 3mile radius of our patisserie in Birmingham. For any other areas please contact us by using the enquiry form to discuss your requirements, we would be happy to see if we can assist.

Every care is taken to ensure our products reach you in optimum condition, however should your order be damaged this should be reported immediately via email, or by calling us on 0121 777 7789. Photographic evidence must be provided.

Petits Fours Patisserie accepts no liability for cakes that are damaged after they have been delivered to the agreed location and signed for. For cakes delivered to venues, Petits Fours Patisserie requires a signed delivery note by the person in charge to say that the cake has arrived and that it arrived in perfect condition.

If you’re out when our drivers arrive, we will try and make contact on the number provided to see if we can leave your order with your neighbours. If we can’t get hold of you, the goods will be taken back to our patisserie and stored for 24 hours. Please note that if we are requested to redeliver the order again it will incur delivery charges. We will store any undelivered cakes for 24 hours, after this period, if no contact has been made we reserve the right to dispose of perishable goods. No refunds will be issued.

Discount

Please note, discounts do not apply to delivery or merchandise items, unless stated otherwise. 

Limitation of Liability
PETITS FOURS PATISSERIE, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, WILL NOT BE LIABLE TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAW, FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, OR ANY OTHER DAMAGE AND LOSS, COSTS, EXPENSES AND PAYMENTS, REGARDLESS OF THE ALLEGED LIABILITY OR FORM OF ACTION, WHETHER IN CONTRACT,  OR OTHERWISE, INCLUDING NEGLIGENCE, INTELLECTUAL PROPERTY INFRINGEMENT, PRODUCT LIABILITY AND STRICT LIABILITY, THAT MAY RESULT FROM, OR IN CONNECTION WITH THE USE OR THE INABILITY TO USE THE WEBSITE, OR FROM THE UNAVAILABILITY OF ORDERED ITEMS, OR FROM DELIVERY DELAYS, OR FROM ANY UNINTENTIONAL FAULT OR ERROR MADE BY PETITS FOURS PATISSERIE LIMITED’S STAFF, OR FROM ANY FRAUDULENT ACTIVITY OR UNAUTHORIZED USE OF CREDIT AND DEBIT CARDS, OR FROM ANY COMMUNICATION WITH PETITS FOURS PATISSERIE LIMITED, REGARDLESS OF WHETHER PETITS FOURS PATISSERIE LIMITED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
